Green Economy in Pesantren-Based Islamic Microfinance Institutions in Madura: Constructing Muamalah Contracts from the Perspective of Qawa'id Fiqhiyyah

Abstract

This study is motivated by a gap in the literature concerning the implementation of the green economy in Islamic microfinance institutions (LKMS), as prior studies have largely remained confined to the conventional macroeconomic level and have not yet addressed community-based religious microfinance institutions, particularly those rooted in pesantren (Islamic boarding schools). This study aims to formulate the application of the green economy in pesantren-based LKMS by addressing two research foci: first, how the green economy is implemented in pesantren-based LKMS in Madura; and second, how muamalah contracts are constructed within the framework of the green economy based on muamalah principles. This research employs an empirical qualitative method with descriptive analysis, using KSPPS NURI as the research object, representing the largest KSPPS in Madura that has implemented green economy policies. The findings indicate that the implementation of the green economy at KSPPS NURI is realized through the digitalization of financial transactions and the restriction of financing contract objects to the greening sector. Both forms of implementation do not violate the pillars (rukun), conditions (syarat), or objectives of the contract, and are in line with maqashid al-shariah, particularly its extension to the dimension of hifzh al-bi'ah (environmental preservation). This research contributes as a reference model for the implementation of green economy practices in Islamic Microfinance Institutions (LKMS)/Sharia Cooperatives for Savings and Financing (KSPPS), as well as serving as a consideration for regulators in formulating policies or operational guidelines for LKMS oriented toward environmental sustainability principles.
